eCloud4 Corporation, a Canadian corporation, takes protecting your privacy seriously. This Privacy Policy (the “Policy”) covers how eCloud4 collects and uses the Personal Information that you provide on our application and in conjunction with any of the services hosted on www.eCloud4.com  including QR code payments, promotion discounts, money transfers and money transfer services accessed by devices with internet access. It also describes the options available to you regarding using your Personal Information , how you can access and update it.

 

This Policy explains what Personal Information we collect about you, with whom we share it, and how you can elect not to share Information with third parties in certain situations. Personal information refers to information inclusive of, but not limited to name and email that can be used to identify the user in an individual basis (the “Personal Information”).

We ask that minors refrain from using our service or submitting any Personal Information to us. Minors (those under the age of 18 years) are not eligible to use our service. 

 

We may modify this Policy at any time, and whenever we do, we will notify you by posting a revised version on the Website. However, if we execute a material change to how we collect, use or store your Personal Information, we will provide advance notice on the Website  and by your provided email. You will then have the opportunity to decide whether to use or disclose your Personal Information  in that new way, either through an “opt-out” procedure or by ending your relationship with us. The changes will be effective 30 days after the date of the email notification.

 

 

 

We may collect, use, store, transfer and process the following Information about you:

 

  1. information you provide by filling in forms on our App, including Information provided when registering to use our App and other core registrations, subscribing to our Services, posting material, or requesting further services. As a verified user , we will also collect and save Information obtained from scanned copies of official identification documents, including your Passport or Drivers’ License. 
  2. information you provide us, or that we may collect from you, when you report a problem with our App;
  3. a record of correspondence if you contact us;
  4. general, aggregated, demographic, and non-personal Information;
  5. details about your computer or mobile device, including (where available) your IP address, operating system, and browser plug-in types, operating system and platform, as well as Information about your general internet usage (e.g., by using technology that stores information on or gains access to your device, such as cookies, tracking pixels, web beacons (collectively, the “Cookies”);
  6. preferences in receiving marketing from, our third-parties and your communication preferences;
  7. information we may receive from other sources, e.g., we also receive identifiers and commercial Information about you directly from the relevant developer or other third-parties, including our service providers, bank partners, and identity verification services; and
  8. any other information we consider necessary to enhance your experience on the App.

  10. information about your usage of the service, including your transaction history, and how and to whom you use the service to send or receive money. 
  11. location data, such as information about your device’s location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access the App. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address) either continuously or while you are using our App to provide certain location-based services. You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your location setting on your device. However, if you choose to opt-out, you may not be able to use certain aspects of the Services.

 

OUR USE OF YOUR INFORMATION

 

We may use information about you in the following manners:

  1. to process your transactions;
  2. to verify your identity;
  3. to provide you with information, products, or services that you request from us or which we feel may interest you;
  4. to collect payment  for your use of the service;
  5. to provide you with location-based services, such as advertising, search results, and other personalized content;
  6. to carry out our obligations arising from any contracts entered into between you and another entity using our site or between you and us; 
  7. to comply with applicable laws and regulations, including but not limited to “know-your-customer,” terrorist financing, and anti-money laundering requirements, among others;
  8. to improve, operate and maintain our Services  and to deliver a better and more personalized service;
  9. to ensure that content from our site is presented most effectively for you and the device you use to access our site;
  10. to comply with legal obligations;
  11. to notify you about changes to our Services;
  12. push notifications. We may request to send you push notifications regarding special discounts related to a merchant near your location; these discounts may be available only through the use of your location and addressed only to you. If you wish to opt out from receiving these types of communications, you may turn them off in your device’s settings.
  13. to protect you, developers, and our partners from fraud, malicious activity, and other privacy and security-related concerns;
  14. to investigate any misuse of our service or developers’ applications, including criminal activity or other unauthorized access to our services;
  15. to develop new services;
  16. to create an account connection between your eCloud4 account and a third-party account or Platform  (such as your online bank account); 
  17. to respond to your comments, questions, inquiries, and customer service requests;
  18. to communicate with you about products, services, offers, and events offered or sponsored by us, and to provide news and other Information we think may be of interest to you;
  19. to monitor and analyze trends, usage, and activities in connection with our Services; and
  20. for any other reason which we deem necessary to enhance your experience of the site.

 

 

How We Share Information With Others 

 

We will share your Personal Information with third-parties only in the manner described in this Policy. We do not sell or rent  the Information we collect to third-parties for their promotional purposes, or any other purposes other than to provide the Services described herein. Third-party companies that are provided with your Personal Information are only authorized to use your personally identifiable Information only as necessary to provide the required services for us. 

Nevertheless, we may share Information about you (including non-public, Personal Information) with: 

 

  1. Third-party service providers under contract with eCloud4 to help us with our business operations, such as transaction processing, fraud prevention, marketing, market research, and validation of Information provided. These third-parties are prohibited from using your Information for their particular business purposes.

It is vital that such affiliated, partner businesses, and other third-parties, have access to the relevant Information to perform their functions. We will ensure that these affiliated, partner businesses, and other third-parties, do not use your Information for other purposes. We may also receive Information from these affiliated, partner businesses and other third-parties (e.g., updated address information), which we may use (e.g., to correct our records).

  1. In the event that we or substantially all of our assets are acquired (by merger or acquisition) or transferred by way of a reorganization, customer information will be one of the transferred assets. We shall notify you in the event of such an occurrence, as well as any choices you may have regarding your Personal Information, by placing a notice on our Website. 
  2. Law enforcement, government officials, or other third parties, in the following circumstances:
    • in connection with a formal request, subpoena, court order, or similar; 
    • any legal procedure that may arise; and, 
    • when we believe in good faith that disclosure is necessary to comply with the law, prevent physical harm or financial loss, report suspected illegal activity, or to investigate violations of our Terms and Conditions. 
  3. Other third-parties that you consent to or direct may include authorizing an account linking for third-party service, account and/or Platform. 

 

We may collect, use, and share Information in an aggregated, de-identified, or anonymized manner for any purpose permitted under law. This includes creating or using aggregated, de-identified, or anonymized data based on the collected Information to develop new services and to facilitate research.

 

Note that our site may, from time to time, contain links to and from websites of our partner networks, advertisers, and/or affiliates. If you follow a link to any of these websites, please note that they have their own privacy policies and eCloud4 does not accept any responsibility or liability for these policies, or any activity that takes place outside of the eCloud4 website or App. Please check these policies before submitting any personal data or other Information to these websites.

 

STORAGE OF YOUR INFORMATION

 

Some of the Information that we collect from you may be transferred to and stored at, a destination outside of Canada. It may also be processed by staff outside Canada who works for us or an affiliated or partner business. Such staff maybe engaged in, among other things, the fulfillment of your order, the processing of your payment details, and the provision of support services.

 

SECURITY

 

We employ industry-accepted standards in protecting the Information you submit to us on our Website and App per this Policy.

We may , for example, use encryption technology to secure your Information during transmission to our site and external firewall and on-host firewall technology to prevent network-level attacks.

It is important for you to protect against unauthorized access to your password and your devices used to access our Services. You are responsible for keeping your password confidential. However, no method of transmission over the Internet, or method of electronic storage is 100% secure .. Although we will do our best to protect your Information, we cannot guarantee the security of your Information transmitted to our App; any transmission of information is at your own risk.

 

You may opt-out from promotional emails to you by selecting the “Unsubscribe” function present in each promotional email we send you. As we are required to contact you on certain occasions to confirm a transaction, changes in account details, or verify your identity, you may not opt-out of all emails. 

 

Chat 

 

We have a chat feature that can be used to answer questions about our service  and assist you with our App’s functionality. If our chat feature is offline, we will collect your name and email address so that we may reply to your request.

 

Social Media Widgets 

 

Our Website may include Social Media Features, such as the Facebook Like button and Widgets, such as the Share this button, or interactive mini-programs that run on our site. These Features may collect your IP address, which page you are visiting on our site and may set a cookie  to enable the Feature to function properly. Social Media Features and Widgets are hosted by a third-party or hosted directly on our site . Your interactions with these features  are governed by the company’s privacy policy providing it. 

 

Referrals 

 

If you choose to use our referral service to tell a friend, family member, or other personal connection about our App, we will ask you for their name and email address. We will automatically send your referral an email and a reminder email inviting them to visit the site. We store this information for the sole purpose of sending this email and tracking the success of your referral. 

 

DATA RETENTION

 

We will only retain your information for as long as reasonably necessary to fulfill the purposes that it was collected for, including to satisfy any legal, regulatory, tax, accounting, or reporting requirements. We may retain your Information for a more extended period in the event of a complaint or if we reasonably believe there is a prospect of litigation regarding our relationship with you.
